Athenians of the fifth and fourth centuries claimed with pride that their ancestors had always lived in Attica, a claim which they expressed by describing themselves as Related to this Athenian belief that they had always lived in Attica was a second, that, as a people, they were literally ‘sprung from the earth’. It is generally assumed that both beliefs developed at a very early date, but this is merely an assumption, and in the course of this paper we will (...) see evidence suggesting, to the contrary, that both ideas were relatively late developments. This paper focuses on the development of the concept of autochthony, as far as our sources allow, in an effort to understand better what autochthony meant to the Athenians. In particular it considers how the Athenians came to think of themselves as ‘born from the earth’. It then suggests how, through the medium of the word the idea of being ‘born from the earth’ came to symbolize ‘living in a place from time immemorial’. Finally it examines how the concept of autochthony was used in contexts which relate it to the ideology of Athenian democracy. (shrink)

Servant leadership and other ethical and moral approaches to leadership have been criticized for focusing on followers to the potential detriment of other stakeholders, specifically shareholders. With individual data collected from 485 respondents nested in 55 similar stores in a single company, within a large metropolitan area in France, we tested a multilevel model whereby servant leadership relates positively to business-unit performance measured by profit growth—a key indicator for shareholders—through the mediation of employee flourishing and revenue growth. With financial performance (...) data collected approximately 15 months after servant leadership was measured, results supported the hypothesized relationships. At the individual level, this study also showed the association of servant leadership and employee flourishing to be negatively moderated by individual perceptions of power distance orientation: the weaker the power distance orientation, the stronger the influence of servant leadership on employee flourishing. Improving on prior studies that relied on data aggregated at the group level and proximal indicators of performance, this multilevel study sheds light on how servant leadership, a prominent form of ethically conscious leadership, may resolve the fundamental tension leaders face vis-à-vis the potentially diverging interests of their stakeholders. Pregnancy-based employment discrimination has long been a topic of interest for gender inequality scholars and civil rights agencies. Prior work suggests that employer stereotypes and financial interests leave pregnant women vulnerable to being fired. We still know little, however, about women’s interpretations of their terminations and how employers justify such decisions in the face of arguably protective laws. This article provides much needed, in-depth analyses of such dynamics and a relational account of pregnancy-based employment discrimination claims. Elaborating on theoretical expositions (...) of power and research surrounding the patriarchal character of organizational life, we draw on unique quantitative and qualitative data from verified cases of pregnancy-based firing discrimination. Our analyses reveal a two-pronged legitimation process where employers symbolically vilified pregnant workers while simultaneously amplifying ostensibly meritocratic organizational procedures and concerns. Pregnancy discrimination plaintiffs attempted to counter employer arguments. Yet, their limited power within the organizational hierarchy along with the culturally resonant nature of employer logics—logics that seem gender-neutral but that reify gendered assumptions and prioritize business profit—place pregnant women at a considerable disadvantage. Without attending to such cultural and structural power imbalances and the relational processes that undergird them, pregnancy discrimination will remain a significant problem. (shrink)

The emerging concern about software piracy and illegal or unauthorized use of information technology and software has been evident in the media and open literature for the last few years. In the course of conducting their academic assignments, the authors began to compare observations from classroom experiences related to ethics in the use of software and information technology and systems. Qualitatively and anecdotally, it appeared that many if not most, students had misconceptions about what represented ethical and unethical behaviors in (...) these realms. Clearly, one can argue that if college students are uncertain about what constitutes appropriate and inappropriate behavior then this uncertainty will be carried forward into their workplaces upon graduation. Furthermore, if their workplaces don't provide ethics training as a component of a new employee orientation program, one can project a potential for unintentional violations and infringements of copyrights and law in the field. This study was conducted among graduate and undergraduate students to gain insight into their attitudes, perceptions and understanding of some of the relevant ethics issues. A questionnaire of 11 statements was employed that described ubiquitous but most likely unethical (or surely dubious) behaviors in the prevailing business and academic environments. Each respondent was asked to evaluate each statement twice (once for “self” and once for “colleague”) on a five-option highly ethical (5) to neutral (3) to highly unethical (1) scale. The statements were worded such that lower instrument score was associated with higher ethical responses. The questionnaire's two-part structure was designed to solicit honest answers. The encouraging learning from this study was that the overall sample and its various sub-samples did not consider any of the eleven behaviors to be “ethical” or “highly ethical.” It was also encouraging to note that the overall sample and all sub-samples considered “highly unethical” those behaviors associated with personal privacy or property or outright theft. This indicated that moral judgment and probity prevail. The discouraging learning was that behaviors associated with the use of enterprise property were viewed as “neutral” i.e., neither “ethical” nor “unethical.” These findings suggested confusion and lack of clarity and definition around workplace deportment as it regards ethics in software and information technology use. The current study suggests that additional research needs to be conducted to define and clarify the issues, which in turn can form the basis for programs to rectify or at least ameliorate the situation. At the Intersection of Due Process and Equal Protection: Expanding the Range of Protected Interests.

A parieto-frontal integration theory (P-FIT) model of human intelligence has been proposed based on a review of neuroimaging literature and lesion studies. The P-FIT model provides an important basis for future research. Future studies involving connectivity analyses and an integrative approach of imaging modalities using the P-FIT model should provide vastly increased understanding of the biological bases of intelligence.

I argue that theoretical developments in the study of the Universal Declaration of Human Rights (UDHR) should occur alongside progress in moral psychology, particularly moral cognition. More specifically, I argue that Universal Moral Grammar (UMG), a model positing an innate, regulative, and universal moral faculty characterizable in terms of rules and principles, fulfills the role of the foundational model needed to usefully conceptualize the UDHR. As such, I provide a detailed account of UMG against competing models in moral psychology. Furthermore, (...) I combine UMG with Talbott’s Historical-Social Process of Moral Discovery and Rawls’s reflective equilibrium to show how the UDHR represents a major development in moral exploration, one indicating a more penetrative look into the inner moral nature of humans that attempts to reach, but does not attain, one interpretation of reflective equilibrium tied to cognitive moral psychology. The victories of the Go-playing artificial intelligence “AlphaGo” against professional player Lee Sedol in 2016 had a profound impact on public and academic perceptions of AI. This event shocked observers, as the ability of a machine to defeat a world champion human in a highly complex game seemed to indicate that a machine had achieved human-like—or more than human—intelligence. But why was AlphaGo so readily anthropomorphized by academic and non-academic audiences alike? Drawing from existing analyses of reactions to and arguments (...) concerning AlphaGo and AI generally, this paper argues that “generative” cognitive science—a school of thought exemplified by the linguistic work of Noam Chomsky—offers two novel contributions to this subject. First, generativism sheds light on an irrational double standard in the study of the human mind in contrast to the study of non-cognitive systems—“methodological dualism”—which, I argue, has been transferred to evaluations of AlphaGo and other AI. Second, by exposing this irrational double standard in perceptions of AI, I employ generativism’s more well-known arguments concerning the nature of human intelligence and its scientific study to the evaluation of AI, exposing deficient interpretations widely used in the case of AlphaGo and AI generally. This paper reconsiders Rubinstein's alternating-offer bargaining game with complete information. We define rationalizability and trembling- hand rationalizability (THR) for multi-stage games with observed actions. We show that rationalizability does not exclude perpetual disagreement or delay, but that THR implies a unique solution. Moreover, this unique solution is the unique subgame perfect equilibrium (SPE). Also, we reconsider an extension of Rubinstein's game where a smallest money unit is introduced: THR rules out the non-uniqueness of SPE in some particular case. Finally, we (...) investigate the assumption of boundedly rational players. Perpetual disagreement is excluded, but not delay. Furthermore, we cannot use the asymmetric Nash bargaining solution as an approximation of the alternating-offer bargaining model once the players are boundedly rational ones. (shrink)

I have difficulty telling people “I’m a doctor,” because I’m not sure I believe it myself. And yet within the past eight months, I have already been challenged to mediate situations that bring me to not only fully accept (...) my vocation as a physician, but also to grow on a mental level, a human level, and a spiritual level. In the following reflection, I recount one of those moments that occurred during a rotation in the medical intensive care unit.At 6 p.m. I was coming on for my night shift knowing that the family of one of the patients I would be caring for had decided earlier in the day to withdraw medical care for their dying sister. The woman had been admitted to the ICU the previous night unconscious and in multi organ system failure—heart, lungs, liver, kidneys, all failed—as a result of chronic alcoholism and most recently drinking daily for three weeks with barely any other dietary intake. She was being kept alive with mechanical ventilation and three IV drips of medications to maintain her blood pressure. She was 45 years old. After a few more hours of saying goodbye, her sister came up to me and said that the family was ready to proceed. To withdraw care. I thought a lot about this phrase we use [End Page 204] “withdrawing care” that night. This encounter was the first time I had ever been the physician entering these orders into the computer. To me, what I was doing that night was in fact the complete opposite of “withdrawing” care. I felt, instead, that I was giving even more care. How?First, by caring more for the patient. By making sure she was comfortably extubated, by helping to reposition her in the hospital bed in a way that appeared more natural, and by praying. I prayed that when we stopped the pressors and the ventilator, she would pass quietly and find peace in Heaven, when she perhaps found very little on Earth.Second, by caring more for her family. It was my responsibility to guide them through this dying process, a process that I had only encountered two or three times previously in my life. I felt unsure, frightened, and nervous, not wanting to make a mistake or be inadvertently insensitive. Once again, prayer and what I perceive to be God’s grace filled me with the love I needed to outline the process, to encourage family members to hold her hand and to speak with her while she died.Once the medications were stopped and she was breathing unassisted, her lungs gasped once … twice. Nevertheless, the family understood, they cried, they held their sister’s hand. Service (1978), prior to Patrick Manson’s (1844–1922) discovery in 1877 that the mosquito Culex fatigans (Diptera: Culicidae) was the intermediate host of Bancroftian filariasis, the association of insects with disease and the nature of disease transmission was almost entirely speculation. As biographers P. H. Manson-Bahr and A. Alcock (1927) put it: “Manson’s investigations were thus the first convincing evidence that the vague beliefs traditional among many untutored races and countenanced from time to time by a few (...) sagacious medical men—beliefs that various specific diseases of the blood are disseminated by bloodsucking insects—were of good pathological report and worthy of further thought” .. Over the centuries, Grotius’s writings on onderzetting (rights of hypothec) have been widely cited, particularly in the Netherlands and South Africa. This article investigates the originality and lasting impact of Grotius’s contributions to this field. The article follows the layout of the chapter on hypothecs of Grotius’s Inleiding tot de Hollandsche Rechts-geleertheyd. It examines Grotius’s translation of hypotheca as onderzetting, the structure of his Inleiding, the distinctions between various kinds of hypothec, and contemporary requirements for the creation of hypothecs. It (...) then explores the right to follow encumbered assets into the hands of third parties and analyses the enforcement of hypothecs, priority issues in cases of competing hypothecs, and reflects on Grotius’s influence on Dutch security rights. In summary, although Grotius’s insights were largely derivative, often echoing interpretations of earlier scholars, they illustrate Grotius’s deep understanding of the influence of Germanic and Roman law on Roman-Dutch security rights. Grotius had a lasting impact on legal scholarship and practice because he was the first to provide a scholarly systematization of Roman-Dutch law within the framework of Justinian’s Institutes and firmly placed the rights of hypothec in the book on property rights of his Inleiding.
